Terms of Service

1. Acceptance of These Terms

These terms govern your use of SmartMemory, including the web application, APIs, SDKs, browser extension, and companion integrations such as the Maya Discord bot (together, the "Service"). By creating an account or using the Service you agree to these terms. If you do not agree, do not use the Service.

2. The Service

SmartMemory is a memory system for people and AI agents. It stores content you choose to save, structures it with AI processing, and makes it searchable and retrievable. Parts of the Service are offered as a beta. Beta features may change, break, or be withdrawn without notice.

3. Your Account

• You must provide accurate account information and keep your credentials secure.
• You are responsible for activity that happens under your account.
• You must be at least 13 years old, or older where local law requires it.

4. Acceptable Use

You agree not to:

• Use the Service to store or distribute unlawful, harmful, or infringing content
• Probe, disrupt, or overload the Service or its infrastructure
• Attempt to access other users' data or workspaces
• Resell or misrepresent the Service without our written permission
• Use the Service to spam, harass, or deceive others on any platform

5. Your Content

You own the content you save to SmartMemory. You grant us a limited license to store, process, and display that content solely to operate the Service for you. We do not use your content to train AI models and we do not sell it. You can export or delete your content at any time, as described in our Privacy Policy.

6. AI-Generated Output

The Service uses AI models to extract, summarize, and generate content. AI output can be inaccurate or incomplete. It is provided for your convenience and is not professional advice. You are responsible for verifying anything you rely on.

7. Maya Discord Bot

Maya is a SmartMemory companion that operates on Discord. If you interact with Maya:

• Your use of Discord remains governed by Discord's own Terms of Service and Community Guidelines.
• Messages you send to Maya, and reactions you add to Maya's messages, are processed to generate replies and to build memory for your conversations, as described in our Privacy Policy.
• You can tell Maya to stop contacting you at any time, and she will.
• Do not use Maya to target, harass, or collect information about other Discord users.

8. Plans and Payment

Free and paid plans are described on our pricing page. Paid subscriptions renew automatically until cancelled. You can cancel at any time and keep access until the end of the paid period. Usage limits apply per plan and we may adjust limits with notice.

9. Availability and Changes

We work to keep the Service available but do not guarantee uninterrupted operation. We may modify or discontinue features, and we will give reasonable notice of material changes where practical.

10. Disclaimers and Liability

The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these terms. On termination we delete or anonymize your data as described in the Privacy Policy.

12. Changes to These Terms

We may update these terms. For material changes we will notify you via email or an in-app notice at least 14 days before they take effect. Continued use after that date means you accept the updated terms.
